The seller nexus s.r.o. (hereinafter also referred to as the “controller”) informs the buyer (hereinafter also referred to as the “data subject”) about the fulfillment of the information obligations pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter only the “Regulation”) and Section 19 of Act No. 18/2018 Coll. on the Protection of Personal Data (hereinafter also referred to as the “Act on Personal Data”) by providing the information below.

3. Purpose of processing personal data:
The purpose is to conclude a purchase contract and pre-contractual relations, to fulfill the rights and obligations arising from the purchase contract.
4. Legal basis for processing personal data:
The legal basis is the provision of Section 13, § 1, letter b) of the Personal Data Protection Act: the processing of personal data is necessary for the performance of a contract to which the data subject is a party, or to take measures prior to the conclusion of a contract at the request of the data subject.
The operator hereby informs the buyer and the interested party as the data subject that, pursuant to Article 6, § 1, letter b) of the Regulation, the data subject will process personal data in the process of concluding a purchase contract without the consent of the data subject, as the processing of personal data will be carried out by the operator within the framework of pre-contractual relations and the conclusion of a purchase contract.

The operator hereby informs the buyer as the data subject that, pursuant to Art. 6(1)(c) of the Regulation, will process personal data without the consent of the data subject, as the processing of personal data is necessary for the fulfillment of the legal obligation of the controller, which is the fulfillment of tax obligations.
5. Identification of the recipient or category of recipient:
The categories of recipients who process personal data are:
External accountant, Postal carrier, Supplier (for the purposes of handling complaints)
State institutions for the purpose of fulfilling the obligations of the controller:
Tax office, state administration and public authority for the exercise of control and supervision (Slovak Trade Inspection, Personal Data Protection Office), bailiff, court, criminal prosecution authority, etc.
6. Retention period for personal data
The retention period for personal data is determined by law for the exercise of rights and obligations arising from a concluded purchase contract (e.g., according to Section 599, § 1 of the Civil Code, the buyer may exercise rights from liability for defects in court within 24 months from the receipt of the goods – the retention of personal data is therefore necessary for the identification of the contracting party); longer processing of personal data is possible only for the sole purpose of archiving accounting documents on the basis of a special regulation.
7. Rights of the data subject
The data subject has the right to:
request access to personal data concerning the data subject from the controller,
to correct personal data,
to erase personal data or restrict the processing of personal data,
to object to the processing of personal data,
to transfer personal data,
to file a motion to initiate proceedings pursuant to Section 100 of the GDPR.

The controller will process the data subject’s request in connection with the above-mentioned rights within the statutory deadlines.
8. Legal or contractual requirement
The data subject is obliged to provide personal data for the purpose specified in these rules, otherwise it is not possible to conclude a purchase contract in which the buyer has expressed interest and subsequently fulfill the rights and obligations arising from the concluded purchase contract for the seller and the buyer.
